A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to carrying a handgun in certain areas of the campus of a |
|
|
public or private institution of higher education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 411.2031, Government Code, is amended by |
|
|
adding Subsection (f) to read as follows: |
|
|
(f) This section does not permit a license holder to possess |
|
|
a concealed handgun, or go with a concealed handgun, on the premises |
|
|
of a child-care facility, as defined by Section 42.002, Human |
|
|
Resources Code, that is located on the campus of an institution of |
|
|
higher education or private or independent institution of higher |
|
|
education if the institution gives effective notice under Section |
|
|
30.06, Penal Code. |
|
|
SECTION 2. Section 46.03, Penal Code, is amended by adding |
|
|
Subsection (j) to read as follows: |
|
|
(j) Subsection (a)(1)(B) does not permit a person to possess |
|
|
a concealed handgun, or go with a concealed handgun, on the premises |
|
|
of a child-care facility, as defined by Section 42.002, Human |
|
|
Resources Code, that is located on the campus of an institution of |
|
|
higher education or private or independent institution of higher |
|
|
education if the institution gives effective notice under Section |
|
|
30.06. |
|
|
SECTION 3. The change in law made by this Act applies only |
|
|
to an offense committed on or after the effective date of this Act. |
|
|
An offense committed before the effective date of this Act is |
|
|
governed by the law in effect on the date the offense was committed, |
|
|
and the former law is continued in effect for that purpose. For |
|
|
purposes of this section, an offense was committed before the |
|
|
effective date of this Act if any element of the offense occurred |
|
|
before that date. |
|
|
SECTION 4. This Act takes effect September 1, 2019. |
