YOUNG, GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to directing the board of trustees of the state university of New York to offer differential nonresident tuition charges to certain students who reside within three hundred miles of the state university of New York at Alfred, Fredonia or Potsdam; and providing for the repeal of such provisions upon the expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph h of subdivision 2 of section 355 of the educa- 2 tion law is amended by adding a new subparagraph 7-a to read as follows: 3 (7-A) COMMENCING IN THE TWO THOUSAND FIFTEEN--TWO THOUSAND SIXTEEN 4 ACADEMIC YEAR, THE STATE UNIVERSITY TRUSTEES SHALL ADOPT REGULATIONS 5 PROVIDING THAT ANY STUDENT WHO IS NOT A RESIDENT OF THIS STATE, BUT 6 RESIDES WITHIN THREE HUNDRED MILES OF THE CAMPUS OF THE STATE UNIVERSITY 7 OF NEW YORK AT ALFRED, FREDONIA OR POTSDAM SHALL PAY TUITION AND FEES 8 FOR MATRICULATION AT SUCH CAMPUS OF THE STATE UNIVERSITY AT A RATE WHICH 9 IS ONE AND ONE-HALF TIMES THE RATE IMPOSED UPON STUDENTS WHO ARE RESI- 10 DENTS OF THIS STATE. PROVIDED THAT, SUCH DIFFERENTIAL RATE SHALL BE 11 OFFERED ONLY TO SUCH ELIGIBLE NONRESIDENT STUDENTS WHICH DO NOT EXCEED 12 TEN PERCENT OF THE ENROLLMENT OPENINGS AT EACH SUCH CAMPUS. EACH STUDENT 13 AFFORDED A DIFFERENTIAL RATE AT THE TIME OF HIS OR HER ENROLLMENT IN 14 THEIR RESPECTIVE INSTITUTION, WHO IS DETERMINED TO BE IN GOOD STANDING, 15 SHALL BE ELIGIBLE FOR SUCH DIFFERENTIAL RATE FOR UP TO FOUR YEARS FROM 16 THE DATE OF HIS OR HER INITIAL ENROLLMENT. THE STATE UNIVERSITY TRUS- 17 TEES SHALL PROMOTE AND MARKET THE AVAILABILITY OF THE DIFFERENTIAL 18 TUITION AND FEES TO INDIVIDUALS WHO WOULD BE ELIGIBLE TO TAKE ADVANTAGE 19 THEREOF. 20 S 2.
