AN ACT relative to the use of a laser pointing device for self-defense or defense of others.

This bill provides that the use of a laser pointing device in self-defense or defense of others shall not be violation of RSA 631:3-a.

STATE OF NEW HAMPSHIRE
In the Year of Our Lord Two Thousand Fourteen
AN ACT relative to the use of a laser pointing device for self-defense or defense of others.
Be it Enacted by the Senate and House of Representatives in General Court convened:
1 Conduct Involving Laser Pointing Device; Exemption. Amend RSA 631:3-a, III to read as follows:
III. It shall be an affirmative defense under this section if the laser pointing device was used in an organized meeting or training class by the instructor or speaker. Nothing in this section shall be construed to limit the use of medical lasers by qualified medical personnel, or construction lasers used by construction personnel, or laser devices utilized by law enforcement personnel in the performance of their official duties. No person shall be found in violation of this section for use of a laser pointing device in self defense or defense of others.
2 Effective Date. This act shall take effect upon its passage.

The Legislative Budget Assistant has determined that this legislation, as introduced, has a total fiscal impact of less than $10,000 in each of the fiscal years 2014 through 2018.
