Section 1. CAPITAL IMPROVEMENT APPROPRIATIONS.
1.19    The sums shown in the column under "Appropriations" are appropriated from the
1.20bond proceeds fund, or another named fund, to the state agencies or officials indicated,
1.21to be spent for public purposes. Appropriations of bond proceeds must be spent as
1.22authorized by the Minnesota Constitution, article XI, section 5, paragraph (a), to acquire
1.23and better public land and buildings and other public improvements of a capital nature, or
1.24as authorized by the Minnesota Constitution, article XI, section 5, paragraphs (b) to (j),
1.25or article XIV. Unless otherwise specified, money appropriated in this act for a capital

Subd. 23.Debt Service
8.19(a) Except as provided in paragraph (b), the
8.20Board of Trustees shall pay the debt service
8.21on one-third of the principal amount of state
8.22bonds sold to finance projects authorized
8.23by this section. After each sale of general
8.24obligation bonds, the commissioner of
8.25management and budget shall notify the
8.26board of the amounts assessed for each year
8.27for the life of the bonds.
8.28(b) The board need not pay debt service
8.29on bonds sold to finance HEAPR. Where a
8.30nonstate match is required, the debt service is
8.31due on a principal amount equal to one-third
8.32of the total project cost, less the match
8.33committed before the bonds are sold.
9.1(c) The commissioner of management and
9.2budget shall reduce the board's assessment
9.3each year by one-third of the net income
9.4from investment of general obligation bond
9.5proceeds in proportion to the amount of
9.6principal and interest otherwise required to
9.7be paid by the board. The board shall pay its
9.8resulting net assessment to the commissioner
9.9of management and budget by December
9.101 each year. If the board fails to make
9.11a payment when due, the commissioner
9.12of management and budget shall reduce
9.13allotments for appropriations from the
9.14general fund otherwise available to the board
9.15and apply the amount of the reduction to
9.16cover the missed debt service payment. The
9.17commissioner of management and budget
9.18shall credit the payments received from the
9.19board to the bond debt service account in
9.20the state bond fund each December 1 before
9.21money is transferred from the general fund
9.22under Minnesota Statutes, section 16A.641,
9.23subdivision 10.

13.5considering the embedded energy in the
13.6building, that is the most energy-efficient and
13.7carbon-reducing method of renovation.

Subd. 3.Buildings and Facilities Development

13.10and a lab/necropsy facility; and to replace
13.11buildings that are in poor condition, outdated,
13.12and no longer support the natural resource

Subd. 4.Flood Hazard Mitigation

13.15(a) For the state share of flood hazard
13.16mitigation grants for publicly owned capital
13.17improvements to prevent or alleviate flood
13.18damage under Minnesota Statutes, section
13.19103F.161. Levee projects, to the extent
13.20practical, shall meet the state standard of
13.21three feet above the 100-year flood elevation.
13.22Project priorities shall be determined by the
13.23commissioner as appropriate and based on
13.24need.
13.25(b) This appropriation includes money for
13.26the projects in Montevideo and Moorhead.
13.27(c) For any project listed in this subdivision
13.28that the commissioner determines is not
13.29ready to proceed or does not expend all the
13.30money allocated to it, the commissioner may
13.31allocate that project's money to a project on
13.32the commissioner's priority list.
13.33(d) To the extent that the cost of a project
13.34exceeds two percent of the median household
14.1income in a municipality or township
14.2multiplied by the number of households in the
14.3municipality or township, this appropriation
14.4is also for the local share of the project.

Subd. 5.Dam Renovation, Repair, Removal

14.6(a) To renovate or remove publicly owned
14.7dams. The commissioner shall determine
14.8project priorities as appropriate under
14.9Minnesota Statutes, sections 103G.511 and
14.10103G.515.
14.11(b) This appropriation includes up to
14.12$3,000,000 for a grant to the city of Champlin
14.13to repair and renovate the Champlin Mill
14.14Pond Dam. Notwithstanding the match
14.15requirements in section 103G.515, the grant
14.16to the city of Champlin does not require any
14.17nonstate match.
14.18(c) $2,400,000 of this appropriation is for
14.19a grant to Blue Earth County to repair and
14.20renovate the Rapidan Dam. Notwithstanding
14.21the match requirements in section 103G.515,

15.12approximately four miles of the Blazing Star
15.13Trail from Myre-Big Island State Park to
15.14Hayward;
15.15(2) $650,000 is to develop and pave
15.16approximately five miles of the Casey Jones
15.17Trail in Pipestone County from County Road
15.1816 through Woodstock and to improve the
15.19trailhead in Pipestone;
15.20(3) $2,750,000 is for the Cuyuna Lakes Trail
15.21segment from Deerwood to Crosby and
15.22the Sagamore Unit of the Cuyuna Country
15.23State Recreation Area, to connect to the Paul
15.24Bunyan Trail and into Lum Park and then to
15.25the airport;
15.26(4) $600,000 is to acquire land and develop
15.27the Gateway Trail from Pine Point Park in
15.28May Township into William O'Brien State
15.29Park;
15.30(5) $1,700,000 is to acquire land and develop
15.31the Gitchi-Gami Trail from a Department
15.32of Transportation wayside rest on Trunk
15.33Highway 61 at Cutface Creek to the existing
15.34trail terminus on the west edge of Grand
15.35Marais;
16.1(6) $1,500,000 is to acquire land and develop
16.2an approximately five mile spur from the
16.3Glacial Lakes Trail through New London and
16.4into Sibley State Park, including a separated
16.5grade crossing of Trunk Highway 71;
16.6(7) $650,000 is to acquire land and develop a
16.7portion of the Goodhue Pioneer Trail;
16.8(8) $3,100,000 is to design, develop, and
16.9complete the Heartland Trail from Detroit
16.10Lakes to Frazee, and to predesign the trail
16.11between Moorhead and Hawley. Any
16.12remaining portion of this amount may be
16.13used to fund the design and completion
16.14of other sections of the Heartland Trail,
16.15including from Park Rapids to Itasca State
16.16Park or from Hawley to Detroit Lakes;
16.17(9) $2,000,000 is to pave approximately
16.1828.5 miles of the Luce Line Trail from the
16.19Carver-McLeod County border to Cedar
16.20Mills in Meeker County;
16.21(10) $550,000 is to acquire land and develop
16.22the Mill Towns Trail segment from Faribault
16.23to Dundas;
16.24(11) $400,000 is for the Minnesota River
16.25Trail between Mankato and St. Peter, and
16.26connections to the Sakatah Singing Hills State
16.27Trail and the Red Jacket Trail in Mankato;
16.28(12) $2,500,000 is to develop the Minnesota
16.29Valley Trail from the Bloomington Ferry
16.30Bridge to the Minnesota Valley Wildlife
16.31Refuge Visitor Center in Bloomington; and
16.32(13) $2,500,000 is to acquire land and
16.33develop approximately 11 miles of the
17.1Shooting Star Trail from Rose Creek to
17.2Austin.
17.3The commissioner may allocate money
17.4not needed to complete a project listed in
17.5this section to another project listed in this
17.6section that may need additional money to
17.7be completed. For any project listed in this
17.8subdivision that the commissioner determines
17.9is not ready to proceed, the commissioner
17.10may reallocate that project's money to
17.11another state trail project described in this
17.12section or other state trail infrastructure.

17.14and senate committees with jurisdiction
17.15over environment and natural resources
17.16and legislators from the affected legislative
17.17districts must be notified of any changes.

50.12    Sec. 28. Laws 2013, chapter 136, section 7, is amended to read:
50.13    Sec. 7. BOND SALE SCHEDULE.
50.14The commissioner of management and budget shall schedule the sale of state
50.15general obligation bonds so that, during the biennium ending June 30, 2015, no more
50.16than $1,280,165,000 $1,254,063,000 will need to be transferred from the general fund to
50.17the state bond fund to pay principal and interest due and to become due on outstanding
50.18state general obligation bonds. During the biennium, before each sale of state general
50.19obligation bonds, the commissioner of management and budget shall calculate the amount
50.20of debt service payments needed on bonds previously issued and shall estimate the amount
50.21of debt service payments that will be needed on the bonds scheduled to be sold. The
50.22commissioner shall adjust the amount of bonds scheduled to be sold so as to remain within
50.23the limit set by this section. The amount needed to make the debt service payments is
50.24appropriated from the general fund as provided in Minnesota Statutes, section 16A.641.

50.25    Sec. 29. APPROPRIATIONS GIVEN EFFECT ONCE.
50.26    If an appropriation in this act is enacted more than once in the 2014 legislative
50.27session, the appropriation must be given effect only once.

50.28    Sec. 30. EFFECTIVE DATE.
50.29    This article is effective the day following final enactment.

50.30ARTICLE 2
50.31MISCELLANEOUS

50.32    Section 1. Minnesota Statutes 2012, section 12A.16, subdivision 5, is amended to read:
51.1    Subd. 5. Waivers authorized. The requirements of section 174.50, subdivisions 5,
51.26, 6a, and to 7, are waived for grants under subdivision 3.

51.3    Sec. 2. Minnesota Statutes 2012, section 16A.641, is amended by adding a subdivision
51.4to read:
51.5    Subd. 4b. Negotiated sales authority. Notwithstanding the public sale requirements
51.6of subdivision 4 and section 16A.66, subdivision 2, the commissioner may sell bonds,
51.7including refunding bonds, at negotiated sale.

51.8    Sec. 3. Minnesota Statutes 2012, section 16A.642, subdivision 1, is amended to read:
51.9    Subdivision 1. Reports. (a) The commissioner of management and budget shall
51.10report to the chairs of the senate Committee on Finance and the house of representatives
51.11Committees on Ways and Means and Capital Investment by January 1 of each
51.12odd-numbered year on the following:
51.13(1) all laws authorizing the issuance of state bonds, bonds supported by a state
51.14appropriation, or appropriating general fund money for state or local government
51.15capital investment projects enacted more than four years before January 1 of that
51.16odd-numbered year; the projects authorized to be acquired and constructed for which
51.17less than 100 percent of the authorized total cost has been expended, encumbered, or
51.18otherwise obligated; the cost of contracts to be let in accordance with existing plans and
51.19specifications shall be considered expended for this report; and the amount of general fund
51.20money appropriated but not spent or otherwise obligated, and the amount of bonds not
51.21issued and bond proceeds held but not previously expended, encumbered, or otherwise
51.22obligated for these projects; and
51.23(2) all laws authorizing the issuance of state bonds, bonds supported by a state
51.24appropriation, or appropriating general fund money for state or local government capital
51.25programs or projects other than those described in clause (1), enacted more than four years
51.26before January 1 of that odd-numbered year; and the amount of general fund money
51.27appropriated but not spent or otherwise obligated, and the amount of bonds not issued
51.28and bond proceeds held but not previously expended, encumbered, or otherwise obligated
51.29for these programs and projects.
51.30(b) The commissioner shall also report on general fund appropriations for capital
51.31projects, bond authorizations or bond proceed balances that may be canceled because
51.32projects have been canceled, completed, or otherwise concluded, or because the purposes
51.33for which the money was appropriated or bonds were authorized or issued have been
51.34canceled, completed, or otherwise concluded. The general fund appropriations, bond
52.1authorizations or bond proceed balances that are unencumbered or otherwise not obligated
52.2that are reported by the commissioner under this subdivision are canceled, effective July 1
52.3of the year of the report, unless specifically reauthorized by act of the legislature.
52.4(c) The reports required by this subdivision shall only contain bond authorizations
52.5supported by a state appropriation and their associated general fund appropriations for
52.6projects authorized or amended after December 31, 2013.

52.7    Sec. 4. Minnesota Statutes 2012, section 16A.642, subdivision 2, is amended to read:
52.8    Subd. 2. Cancellation. (a) If the commissioner determines that the purposes for
52.9which general obligation bonds of the state or bonds supported by a state appropriation
52.10 have been issued or for which general fund monies were appropriated are accomplished
52.11or abandoned, after consultation with the affected agencies, and there is a remaining
52.12authorization or appropriation for a specific project of $500 or less, the commissioner may
52.13cancel the remaining authorization or appropriation for that project. Bonds supported by
52.14a state appropriation shall only be canceled if they were authorized or amended after
52.15December 31, 2013.
52.16(b) If a premium received on the sale of bonds is credited to the bond proceeds
52.17fund, pursuant to section 16A.641, subdivision 7, paragraph (b), the corresponding bond
52.18authorization to which the premium is attributable must be reduced accordingly by the
52.19commissioner.
52.20(c) The commissioner must notify the chairs of the senate Finance Committee and
52.21the house of representatives Capital Investment Committee of any bond authorizations,
52.22including bond authorizations supported by a state appropriation, or general fund
52.23appropriations canceled under this subdivision.

52.24    Sec. 5. [116J.434] PUBLIC BUILDING ACCESSIBILITY GRANT PROGRAM.
52.25    Subdivision 1. Creation of account. A public building accessibility account
52.26is created in the bond proceeds fund. Money in the account is appropriated to the
52.27commissioner for grants under this section.
52.28    Subd. 2. Definitions. For the purposes of this section:
52.29(1) "accessible" means satisfies the requirements of the State Building Code for
52.30accessibility by persons with disabilities;
52.31(2) "eligible project" means predesign, design, acquisition of land or an interest in
52.32land, construction, renovation, or other improvement or betterment of a capital nature to
52.33make a building or facility owned by a local government unit accessible or improve its
52.34accessibility;
53.1(3) "governing body" means the county board of commissioners, city council, or
53.2town board of supervisors; and
53.3(4) "local government unit" means a county, statutory or home rule charter city,
53.4or town.
53.5    Subd. 3. Grant program established. The commissioner shall make grants to local
53.6government units on a first-come, first-served basis for eligible projects.
53.7    Subd. 4. Application. A local government unit seeking a grant under this section
53.8must apply to the commissioner in the form and manner determined by the commissioner.
53.9The application must include:
53.10(1) a resolution of the governing body requesting the grant and stating that the local
53.11government unit has or will have in a timely manner the required nonstate contribution
53.12necessary to complete the project;
53.13(2) a detailed description of the project and cost estimate, along with necessary
53.14supporting evidence; and
53.15(3) any other information the commissioner determines is necessary or useful.
53.16    Subd. 5. Maximum grant amount; match. A local unit of government must not
53.17be awarded in aggregate more than $150,000, whether for one or more projects in one or
53.18more years. The local government unit awarded a grant under this section must provide
53.19at least an equal amount from nonstate sources which may include contributions made
53.20before the grant is awarded.

53.21    Sec. 6. Minnesota Statutes 2012, section 134.45, subdivision 5b, is amended to read:
53.22    Subd. 5b. Qualification; improvement grants. A public library jurisdiction may
53.23apply for a grant in an amount up to $1,000,000 or 50 percent, whichever is less, of the
53.24approved costs of renovating or expanding an existing library building, or to construct
53.25a new library building. Renovation may include remediation of conditions hazardous
53.26to health or safety.

53.27    Sec. 7. Minnesota Statutes 2012, section 135A.034, subdivision 2, is amended to read:
53.28    Subd. 2. Capital projects. The Board of Regents of the University of Minnesota
53.29and the Board of Trustees of the Minnesota State Colleges and Universities are requested
53.30to consider the following criteria in establishing priorities for requests for bond funds
53.31for capital projects:
53.32(1) maintenance and preservation of existing facilities;
53.33(2) completion of projects that have received funding;
53.34(3) updating facilities to meet contemporary needs;
54.1(4) providing geographic distribution of capital projects; and
54.2(5) maximizing the use of nonstate contributions.
54.3The criteria listed in this subdivision are not in priority order.

54.4    Sec. 8. Minnesota Statutes 2012, section 174.50, subdivision 6b, is amended to read:
54.5    Subd. 6b. Bridge engineering and design costs in smaller cities. Until June 30,
54.62007, (a) The commissioner may make grants from the state transportation fund to a
54.7home rule or statutory city with a population of 5,000 or less and a net tax capacity of
54.8under $200,000 for design and preliminary, engineering, and construction of bridges
54.9on city streets.
54.10(b) Grants under this subdivision are subject to the procedures and criteria
54.11established under subdivisions 5 and, 6, and 7.
54.12(c) Grants may be used for:
54.13(1) 100 percent of the design and preliminary engineering costs that are in excess of
54.14$10,000;
54.15(2) 100 percent of the bridge approach work costs that are in excess of $10,000; and
54.16(3) 100 percent of the bridge construction work costs.
54.17Total grants under this subdivision to all cities may not exceed $200,000.

54.18    Sec. 9. Minnesota Statutes 2012, section 174.50, subdivision 7, is amended to read:
54.19    Subd. 7. Bridge grant program requirements; rulemaking. (a) The commissioner
54.20of transportation shall develop rules, procedures for application for grants, conditions of
54.21grant administration, standards, and criteria as provided under subdivision 6, including
54.22bridge specifications, in cooperation with road authorities of political subdivisions, for use
54.23in the administration of funds appropriated to the commissioner and for the administration
54.24of grants to subdivisions.
54.25(b) The maximum use of standardized bridges is encouraged. Regardless of the size
54.26of the existing bridge, a bridge or replacement bridge is eligible for assistance from the
54.27state transportation fund if a hydrological survey indicates that the bridge or replacement
54.28bridge must be ten feet or more in length.
54.29(c) As part of the standards or rules, the commissioner shall, in consultation with
54.30local road authorities, establish a minimum distance between any two bridges that cross
54.31over the same river, stream, or waterway, so that only one of the bridges is eligible for a
54.32grant under this section. As appropriate, the commissioner may establish exceptions from
54.33the minimum distance requirement or procedures for obtaining a variance.
55.1(d) Political subdivisions may use grants made under this section to construct or
55.2reconstruct bridges, including but not limited to:
55.3(1) matching federal aid grants to construct or reconstruct key bridges;
55.4(2) paying the costs to abandon an existing bridge that is deficient and in need of
55.5replacement but where no replacement will be made; and
55.6(3) paying the costs to construct a road or street to facilitate the abandonment of
55.7an existing bridge if the commissioner determines that the bridge is deficient, and that
55.8construction of the road or street is more economical than replacement of the existing
55.9bridge.
55.10(e) Funds appropriated to the commissioner from the Minnesota state transportation
55.11fund shall be segregated from the highway tax user distribution fund and other funds
55.12created by article XIV of the Minnesota Constitution.

55.13    Sec. 10. Minnesota Statutes 2012, section 174.52, subdivision 3, is amended to read:
55.14    Subd. 3. Advisory committee. (a) The commissioner shall establish an a local road
55.15improvement program advisory committee consisting of five members, including:
55.16(1) one county commissioner;
55.17(2) one county engineer;
55.18(3) one city engineer;
55.19(4) one city council member or city administrator representing a city with a
55.20population over 5,000; and
55.21(5) one city council member or city administrator representing a city with a
55.22population under 5,000.
55.23(b) The advisory committee shall provide recommendations to the commissioner
55.24regarding expenditures from the trunk highway corridor projects account accounts
55.25established in this section.

60.22    Sec. 19. REVISOR'S INSTRUCTION.
60.23The revisor of statutes shall change the headnote for Minnesota Statutes, section
60.24134.45, to "LIBRARY CONSTRUCTION GRANTS."

60.25    Sec. 20. EFFECTIVE DATE.
60.26    Except as otherwise provided, this article is effective the day following final
60.27enactment.
