HOUSE BILL NO. 5094

A bill to amend 1927 PA 372, entitled

"An act to regulate and license the selling, purchasing, possessing, and carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices; to prohibit the buying, selling, or carrying of certain firearms, gas ejecting devices, and electro-muscular disruption devices without a license or other authorization; to provide for the forfeiture of firearms and electro-muscular disruption devices under certain circumstances; to provide for penalties and remedies; to provide immunity from civil liability under certain circumstances; to prescribe the powers and duties of certain state and local agencies; to prohibit certain conduct against individuals who apply for or receive a license to carry a concealed pistol; to make appropriations; to prescribe certain conditions for the appropriations; and to repeal all acts and parts of acts inconsistent with this act,"

(MCL 28.421 to 28.435) by adding section 2c.

the people of the state of michigan enact:

Sec. 2c. (1) Except as otherwise provided in subsection (2), an individual shall not openly carry a firearm in this state.

(2) Subsection (1) does not apply to any of the following:

(a) A member of the organized militia who has registered with the department of state police or the county sheriff of the county in which that individual resides.

(b) An individual engaged in target practice at a recognized target range.

(c) An individual who is hunting.

(d) A peace officer carrying a firearm during the performance of his or her duties.

(e) An individual who is on property owned by that individual.

(f) A member of the United States Armed Forces while carrying the firearm in the line of duty.

(3) As used in this section, "organized militia" means that term as described in section 109 of the Michigan military act, 1967 PA 150, MCL 32.509.
