H.F. 2013 Section 1. Section 97B.49B, subsection 1, paragraph e, Code 1 2014, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (13) A person other than a deputy 3 sheriff, jailer, or detention officer who is employed by a 4 sheriff to provide courthouse security services or prisoner 5 transportation duties, is required as a condition of employment 6 to carry a firearm and has been professionally trained and 7 qualified in the use of any firearm in connection with the 8 individual’s duties, is required and authorized under limited 9 circumstances to perform law enforcement duties that may 10 include but are not limited to detaining persons, taking 11 persons into custody, making arrests, transporting or providing 12 custody and care for those persons under the sheriff’s control, 13 and is a certified Iowa peace officer, has Iowa reserve 14 peace officer certification, or has equivalent peace officer 15 training. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill provides that persons employed by a sheriff 20 to provide courthouse security or prisoner transportation 21 duties who are required to carry a firearm, have peace officer 22 training, and are required to perform certain law enforcement 23 duties, are included within the protection occupation category 24 of the Iowa public employees’ retirement system. 25 -1- LSB 5263YH (6) 85 ec/sc 1/ 1
