Reporting
lost
or
stolen

firearms.

1.
An
individual,
firm,
or
corporation
that
owns
a
firearm
3
who
reports
any
loss
or
theft
of
the
firearm
to
the
law
4
enforcement
agency
having
jurisdiction
over
the
location
where
5
the
loss
or
theft
of
the
firearm
occurred,
if
that
location
is
6
known;
or
to
the
law
enforcement
agency
having
jurisdiction
7
over
the
location
where
the
individual
resides
or
the
firm
8
or
corporation
has
its
principal
place
of
business,
if
the
9
location
where
the
loss
or
theft
of
the
firearm
occurred
is
10
not
known,
shall
have
an
affirmative
defense
against
civil
11
and
criminal
liability
if
the
lost
or
stolen
firearm
is
12
subsequently
used
to
commit
a
crime
or
cause
an
injury
to
any
13
other
person.

2.
The
report
of
a
lost
or
stolen
firearm,
pursuant
to
15
subsection
1,
shall
include
the
following
information,
to
the
16
extent
known
by
the
individual,
firm,
or
corporation
filing
the
17
report:
18
a.
The
caliber
of
the
firearm.
19
b.
The
make
of
the
firearm.
20
c.
The
model
of
the
firearm.
21
d.
The
manufacturer
of
the
firearm.
22
e.
The
serial
number
of
the
firearm.
23
f.
Any
other
distinguishing
number
or
identification
mark
24
on
the
firearm.
25
g.
Any
additional
relevant
information
required
by
the
law
26
enforcement
agency
receiving
the
report.

3.
An
individual,
firm,
or
corporation
that
fails
to
file
28
a
report
when
the
individual,
firm,
or
corporation
knows
29
or
should
know
that
a
firearm
under
the
ownership
of
the
30
individual,
firm,
or
corporation
is
lost
or
was
stolen
may
be
31
held
liable
if
the
firearm
is
subsequently
found
to
have
been
32
used
in
the
furtherance
of
illegal
activity.

4.
Any
law
enforcement
agency
to
which
an
individual,
firm,
34
or
corporation
reports
the
loss
or
theft
of
a
firearm
pursuant

subsection

shall
provide
the
individual
reporting
the
loss
1
or
theft
with
written
confirmation
of
receipt
of
the
report.

EXPLANATION
3
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
4
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
reporting
requirements
for
lost
or
6
stolen
firearms.
7
The
bill
provides
that
an
individual,
firm,
or
corporation
8
that
owns
a
firearm
who
reports
any
loss
or
theft
of
the
9
firearm
to
the
law
enforcement
agency
having
jurisdiction
over
10
the
location
where
the
loss
or
theft
of
the
firearm
occurred
11
or,
if
the
location
where
the
loss
or
theft
of
the
firearm
12
occurred
is
not
known,
to
the
law
enforcement
agency
having
13
jurisdiction
over
the
location
where
the
individual
resides
or
14
the
firm
or
corporation
has
its
principal
place
of
business
15
shall
have
an
affirmative
defense
against
civil
and
criminal
16
liability
if
the
lost
or
stolen
firearm
is
subsequently
used
17
to
commit
a
crime
or
cause
injury
to
another
person.
The
18
report
of
a
lost
or
stolen
firearm
shall
include
the
following
19
information,
to
the
extent
known:
the
caliber,
make,
model,
20
manufacturer,
serial
number,
any
other
distinguishing
number
or
21
identification
mark
on
the
firearm,
and
any
additional
relevant
22
information
required
by
the
law
enforcement
agency
receiving
23
the
report.
Any
law
enforcement
agency
receiving
a
report
of
a
24
lost
or
stolen
firearm
shall
provide
the
individual
reporting
25
the
loss
or
theft
with
written
confirmation
of
receipt
of
the
26
report.
27
The
bill
provides
that
an
individual,
firm,
or
corporation
28
that
fails
to
file
a
report
when
the
individual,
firm,
or
29
corporation
knows
or
should
know
that
a
firearm
under
the
30
ownership
of
the
individual,
firm,
or
corporation
is
lost
or
31
was
stolen
may
be
held
liable
if
the
firearm
is
subsequently
32
used
illegally.
