Section 724.22, subsection 5, Code 2015, is 1 2 amended to read as follows: 1 3 5. A parent or guardian or spouse who is twenty=one years of 1 4 age or older, of a personfourteen years of age but less than 1 5below the age of twenty=one may allow the person to possess a 1 6 pistol or revolver or the ammunition therefor for any lawful 1 7 purpose while under the direct supervision of the parent or 1 8 guardian or spouse who is twenty=one years of age or older, or 1 9 while the person receives instruction in the proper use thereof 1 10 from an instructor twenty=one years of age or older, with the 1 11 consent of such parent, guardian or spouse. 1 12 EXPLANATION 1 13 The inclusion of this explanation does not constitute agreement with 1 14 the explanation's substance by the members of the general assembly. 1 15 This bill relates to the possession of a pistol, revolver, or 1 16 ammunition by a person under 14 years of age. 1 17 Under the bill, a parent, guardian, or spouse who is 21 years 1 18 of age or older, or another with the express consent of the 1 19 minor's parent, guardian, or spouse who is 21 years of age or 1 20 older, may allow a minor to possess a pistol or revolver or the 1 21 ammunition therefor, which then may be lawfully used. Current 1 22 law prohibits a parent, guardian, or spouse who is 21 years of 1 23 age or older from allowing a minor under 14 years of age from 1 24 possessing a pistol, revolver, or the ammunition. 1 25 Except for the circumstances under Code section 724.22(4) 1 26 (security personnel) or (5), a person who sells, loans, gives, 1 27 or makes available a pistol or revolver or ammunition for a 1 28 pistol or revolver to a person below the age of 21 commits a 1 29 serious misdemeanor for a first offense and a class "D" felony 1 30 for second and subsequent offenses. 1 31 An aggravated misdemeanor is punishable by confinement for 1 32 no more than two years and a fine of at least $625 but not more 1 33 than $6,250. A class "D" felony is punishable by confinement 1 34 for no more than five years and a fine of at least $750 but not 1 35 more than $7,500. LSB 1157YH (7) 86 jm/rj
