SYNOPSIS AS INTRODUCED:








515 ILCS 5/20-55 from Ch. 56, par. 20-55
520 ILCS 5/3.2 from Ch. 61, par. 3.2

 Amends the Fish and Aquatic Life Code and the Wildlife Code. Provides that the fees for sport fishing licenses and for hunting licenses to hunt all species for non-residents who have been awarded a Purple Heart by a branch of the armed forces of the United States shall be the same as the fees for a resident. Provides that Purple Heart recipients must provide to the Department of Natural Resources verification of their service and receipt of a Purple Heart. Provides that the Department shall establish what constitutes suitable verification of service and receipt of a Purple Heart for the purpose of issuing non-resident Purple Heart recipients sport fishing
licenses and hunting licenses at a reduced fee.

1 AN ACT concerning wildlife.


2 Be it enacted by the People of the State of Illinois,

3represented in the General Assembly:



4 Section 5. The Fish and Aquatic Life Code is amended by 
5changing Section 20-55 as follows:




6 (515 ILCS 5/20-55) (from Ch. 56, par. 20-55)



7 Sec. 20-55. License fees for non-residents. Fees for 
8licenses for
non-residents of the State of Illinois are as 
9follows:

10 (a) For sport fishing devices as defined by Section
10-95, 
11or spearing
devices as defined in Section 10-110, non-residents 
12age 16 or older shall be
charged $31 for a fishing license to 
13fish. For sport fishing devices as defined
by Section 10-95, or 
14spearing devices as defined in Section 10-110, for a
period not 
15to exceed 3 consecutive days fishing in the State of Illinois 
16the
fee is $15.00.

17 For sport fishing devices as defined in Section 10-95,
or 
18spearing
devices as defined in Section 10-110, for 24 hours of 
19fishing the fee is $10. This license does not exempt the 
20licensee from
the salmon or inland trout stamp requirement.

21 The fee for a sport fishing license for non-residents who 
22have been awarded a Purple Heart by a branch of the armed 
23forces of the United States shall be the same as the fee for a

1resident. Purple Heart recipients must provide to the 
2Department verification of their service and receipt of a 
3Purple Heart. The Department shall establish what constitutes 
4suitable verification of service and receipt of a Purple Heart 
5for the purpose of issuing non-resident Purple Heart recipients 
6sport fishing
licenses at a reduced fee. 
7 (b) All non-residents before using any commercial fishing 
8device
shall obtain a non-resident commercial fishing license, 
9the fee for
which shall be $300 and a non-resident fishing 
10licensing. Each and every commercial device shall be
licensed 
11by a non-resident commercial fisherman as follows:


12  (1) For each 100 lineal yards, or fraction thereof, of 
13 seine
(excluding minnow seines) the fee is $36.


14  (2) For each device to fish with a 100 hook trot line

15 device,
basket trap, hoop net, or dip net the fee is $6.


16  (3) For each 100 lineal yards, or fraction thereof, of 
17 trammel net
the fee is $36.


18  (4) For each 100 lineal yards, or fraction thereof, of 
19 gill net
the fee is $36.

20 All persons required to have and failing to have the 
21license provided
for in subsection (a) of this Section shall be 
22fined under Section 20-35
of this Code. Each person required to 
23have and failing to have the
licenses required under subsection 
24(b) of this Section shall be guilty of a
Class B misdemeanor.

25 All licenses provided for in this Section shall expire on 
26March 31 of
each year; except that the 24-hour license for

1sport fishing devices or
spearing devices shall
expire 24 hours 
2after the effective date and time listed on the face of the

3license and licenses for sport fishing devices
or spearing

4devices for a period not to exceed 3 consecutive days fishing 
5in the
State of Illinois as provided in subsection (a) of this 
6Section shall
expire at midnight on the tenth day after issued, 
7not counting the day
issued.

9 Section 10. The Wildlife Code is amended by changing 
10Section 3.2 as follows:



11 (520 ILCS 5/3.2) (from Ch. 61, par. 3.2)



12 Sec. 3.2. Hunting license; application; instruction. 
13Before the
Department or any county, city, village, township, 
14incorporated town clerk
or his duly designated agent or any 
15other person authorized or designated
by the Department to 
16issue hunting licenses shall issue a hunting license
to any 
17person, the person shall file his application with the 
18Department or
other party authorized to issue licenses on a 
19form provided by the
Department and further give definite proof 
20of identity and place of legal
residence. Each clerk 
21designating agents to issue licenses and stamps
shall furnish 
22the Department, within 10 days following the appointment, the

23names and mailing addresses of the agents. Each clerk or his 
24duly
designated agent shall be authorized to sell licenses and

1stamps only
within the territorial area for which he was 
2elected or appointed. No duly
designated agent is authorized to 
3furnish licenses or stamps for
issuance by any other business 
4establishment. Each
application shall be executed and sworn to 
5and shall set forth the name
and description of the applicant 
6and place of residence.

7 No hunting license shall be issued to any person born on or 
8after January
1,
1980
unless he presents the person authorized 
9to issue the license
evidence that he has held a hunting 
10license issued by the State of Illinois
or another state in a 
11prior year, or a certificate of competency as
provided in this 
12Section. Persons under 16 years of age may be issued a
Lifetime 
13Hunting or Sportsmen's Combination License as provided under 
14Section
20-45 of the Fish and Aquatic Life Code but shall not 
15be entitled to hunt
unless they have a certificate of 
16competency as provided in this Section and
they shall have the 
17certificate in their possession while hunting.

18 The Department of Natural Resources shall authorize

19personnel of the
Department or certified volunteer instructors 
20to conduct courses, of not
less than 10 hours in length, in 
21firearms and hunter safety, which may include
training in bow 
22and arrow safety, at regularly specified intervals throughout

23the State. Persons successfully completing the course shall 
24receive a
certificate of competency. The Department of Natural 
25Resources may further
cooperate with any reputable association 
26or organization in establishing
courses if the organization has

1as one of its objectives the promotion of
safety in the 
2handling of firearms or bow and arrow.

3 The Department of Natural Resources shall designate any

4person found by it
to be competent to give instruction in the 
5handling of firearms, hunter
safety, and bow and arrow. The 
6persons so appointed shall give the
course of instruction and 
7upon the successful completion shall
issue to the person 
8instructed a certificate of competency in the safe
handling of 
9firearms, hunter safety, and bow and arrow. No charge shall
be 
10made for any course of instruction except for materials or 
11ammunition
consumed. The Department of Natural Resources shall

12furnish information on
the requirements of hunter safety 
13education programs to be distributed
free of charge to 
14applicants for hunting licenses by the persons
appointed and 
15authorized to issue licenses. Funds for the conducting of

16firearms and hunter safety courses shall be taken from the fee 
17charged
for the Firearm Owners Identification Card.

18 The fee for a hunting license to hunt all species for a 
19resident of
Illinois is $12. For residents age 65 or older, 
20and, commencing with the 2012 license year, resident veterans 
21of the United States Armed Forces after returning from service 
22abroad or mobilization by the President of the United States, 
23the fee is one-half of the
fee charged for a hunting license to 
24hunt all species for a resident of
Illinois. Veterans must 
25provide to the Department, at one of the Department's 5 
26regional offices, verification of their service. The

1Department shall establish what constitutes suitable 
2verification of service for the purpose of issuing resident 
3veterans hunting
licenses at a reduced fee. Non-residents 
4Nonresidents shall be charged $57 for a hunting license. The 
5fee for a hunting license to hunt all species for non-residents 
6who have been awarded a Purple Heart by a branch of the armed 
7forces of the United States shall be $12. Purple Heart 
8recipients must provide to the Department verification of their 
9service and award. The Department shall establish what 
10constitutes suitable verification of service and receipt of a 
11Purple Heart for the purpose of issuing non-resident Purple 
12Heart recipients hunting
licenses at a reduced fee.

13 Non-residents Nonresidents may be issued a non-resident 
14nonresident hunting license for a
period not to exceed 10 
15consecutive days' hunting in the State and shall
be charged a 
16fee of $35.

17 A special non-resident nonresident hunting license 
18authorizing a non-resident nonresident to
take game birds by 
19hunting on a game breeding and hunting preserve
area only, 
20established under Section 3.27, shall be issued upon proper

21application being made and payment of a fee equal to that for a 
22resident
hunting license. The expiration date of this license 
23shall be on the same
date each year that game breeding and 
24hunting preserve
area licenses expire.

25 Each applicant for a State Migratory Waterfowl Stamp, 
26regardless of
his residence or other condition, shall pay a fee

1of $15 and
shall receive a stamp. Except as provided under

2Section 20-45 of the Fish and Aquatic Life Code,
the stamp 
3shall be signed by the person or affixed to his license
or 
4permit in a space designated by the Department for that 
5purpose.

6 Each applicant for a State Habitat Stamp, regardless of his 
7residence
or other condition, shall pay a fee of $5 and shall 
8receive a
stamp. Except as provided under Section 20-45 of the 
9Fish and Aquatic Life
Code, the stamp shall be signed by the 
10person or affixed to his license or
permit in a space 
11designated by the Department for that purpose.

12 Nothing in this Section shall be construed as to require 
13the purchase
of more than one State Habitat Stamp by any person 
14in any one license year.

15 The Department shall furnish the holders of hunting 
16licenses and stamps
with an insignia as evidence of possession 
17of license, or license and
stamp, as the Department may 
18consider advisable. The insignia shall be
exhibited and used as 
19the Department may order.

20 All other hunting licenses and all State stamps shall 
21expire upon
March 31 of each year.

22 Every person holding any license, permit, or stamp issued 
23under the
provisions of this Act shall have it in his 
24possession for immediate
presentation for inspection to the 
25officers and authorized employees of
the Department, any 
26sheriff, deputy sheriff, or any other peace officer making
a

1demand for it. This provision shall not apply to Department 
2owned or
managed sites where it is required that all hunters 
3deposit their license,
permit, or Firearm Owner's 
4Identification Card at the check station upon
entering the 
5hunting areas.
