AMENDMENT TO HOUSE BILL 2769
2 AMENDMENT NO. ______. Amend House Bill 2769, AS AMENDED,
3by replacing everything after the enacting clause with the
4following:
5 "Section 1. Short title. This Act may be cited as the
6Microstamping Funding Program Act.
7 Section 5. Legislative findings. The General Assembly
8finds that:
9 Law enforcement makes an arrest in only 35% of firearm
10homicides and 21% of firearm assaults when the victim was
11Black or Hispanic. Microstamping is a powerful crime-solving
12tool that can help law enforcement quickly solve gun crimes.
13Microstamping is a reliable ballistics identification tool,
14and can greatly enhance traditional ballistics analysis and
15the current National Integrated Ballistics Information Network
16(NIBIN) system by providing a direct link between a spent

1cartridge case and a firearm.
2 The leads generated from fired cartridge cases, bearing
3microstamps found at crime scenes, have the potential to help
4law enforcement solve gun-related crimes while limiting
5negative interactions with law enforcement, especially in
6minority communities. While this crime-solving technology
7exists, firearm manufacturers have not yet produced
8microstamp-ready firearms.
9 It behooves the State to install a program in partnership
10with law enforcement to bring microstamp-ready firearms into
11use in Illinois.
12 Section 10. Definitions. In this Act:
13 "CGIC" means the Crime Gun Intelligence Center.
14 "Microstamp-ready" means that the firearm is capable of
15producing a unique alphanumeric or geometric code on at least
16one location on each expended cartridge case that can be used
17to identify the make, model, and serial number of the firearm.
18 "Microstamping component or mechanism" means a component
19or mechanism of a firearm or an insertable component or
20mechanism designed and intended to produce a unique
21alphanumeric or geometric code on an expended cartridge that
22identifies the make, model, and serial number of the firearm.
23 "NIBIN" means the National Integrated Ballistics
24Information Network.

1 Section 15. Grants for microstamp-ready firearms or
2insertable microstamping components or mechanisms, or both.
3 (a) There is created in the State treasury the
4Microstamp-ready Firearms Fund to be administered by the
5Illinois Criminal Justice Information Authority for the
6purpose of issuing grants to law enforcement agencies to
7purchase or replenish microstamp-ready firearms or insertable
8microstamping components or mechanisms to be installed in
9firearms, or both, for their officers.
10 (b) Subject to appropriation, the State Comptroller shall
11transfer from the General Revenue Fund to the Microstamp-ready
12Firearms Fund $500,000 to establish a grant program for
13microstamp-ready firearms in Illinois. The program shall
14award:
15 (1) Replenishment grants: grants between $35,000 and
16 $50,000, for the replenishment of new microstamp-ready
17 firearms or insertable microstamping components or
18 mechanisms, or both, for their law enforcement officers.
19 One of these grants shall be for a State law enforcement
20 agency, and the other 3 shall be for 3 municipal law
21 enforcement agencies of municipalities with a population
22 between 50,000 and 200,000 that purchase firearms for
23 their officers through a quartermaster system, in which
24 the quartermaster is responsible for the purchase,
25 inventory, and dissemination of uniforms and equipment to
26 officers.

1 (2) New officer grants: grants between $5,000 to
2 $20,000 to law enforcement agencies of municipalities with
3 a population between 30,000 and 200,000 to assist with the
4 purchase of firearms by new officers.
5 (c) Nothing in this Act prohibits State or municipal law
6enforcement agencies from purchasing or replenishing
7microstamp-ready firearms or insertable microstamping
8components or mechanisms, or both, for their law enforcement
9officers from funding sources independent of the provisions of
10this Act.
11 Section 20. Administration and restrictions. The grant
12program shall be administered by the Illinois Criminal Justice
13Information Authority and the grant funds shall only be used
14for the purchase of microstamp-ready firearms or microstamping
15components or mechanisms, or both, to be installed in firearms
16by law enforcement agencies that are grant recipients.
17 Section 25. Education and training. Education and training
18associated with microstamp-ready firearms, and integration
19with the NIBIN and CGIC centers in Illinois shall be included
20in the program.
21 Section 30. Grant application and participation. The
22Illinois Criminal Justice Information Authority shall
23establish the objectives and provide direction for the

1program's grant application process, by which qualified law
2enforcement agencies can apply to receive funds for
3microstamp-ready firearms or insertable microstamping
4components or mechanisms, or both, for use by their officers.
5Law enforcement agencies participating in the grant program
6must have their officers using the microstamp-ready firearms
7or insertable microstamping components or mechanisms, or both,
8as soon as they are delivered. The Illinois Criminal Justice
9Information Authority must establish the grant program and
10post the Notice of Funding Opportunity no later than September
111, 2022.
12 All grants under this program must be awarded by June 30,
132023.
14 Law enforcement agencies that have been awarded funds must
15use the funds within one year of receipt or the funds shall be
16returned to the State treasury to be deposited into the
17General Revenue Fund. Funds are only to be used for the
18purchase of microstamp-ready firearms or insertable
19microstamping components or mechanisms to be installed in
20firearms.
21 Section 35. Data collection. The Illinois Criminal Justice
22Information Authority shall collect data from each grant
23recipient, including but not limited to: the number of
24microstamp-ready firearms or insertable microstamping
25components or mechanisms, or both, purchased, manufacturer,

1number of officers using the microstamp-ready firearms, and
2the number of microstamp-ready firearms that are discharged in
3the first year of use.
4 Section 90. The Illinois Administrative Procedure Act is
5amended by adding Section 5-45.21 as follows:
6 (5 ILCS 100/5-45.21 new)
7 Sec. 5-45.21. Emergency rulemaking; Illinois Criminal
8Justice Information Authority. To provide for the expeditious
9and timely implementation of the Microstamping Funding Program
10Act, emergency rules implementing the Microstamping Funding
11Program Act may be adopted in accordance with Section 5-45 by
12the Illinois Criminal Justice Information Authority. The
13adoption of emergency rules authorized by Section 5-45 and
14this Section is deemed to be necessary for the public
15interest, safety, and welfare.
16 This Section is repealed one year after the effective date
17of this amendatory Act of the 102nd General Assembly.
18 Section 95. The State Finance Act is amended by adding
19Section 5.970 as follows:
20 (30 ILCS 105/5.970 new)
21 Sec. 5.970. The Microstamp-ready Firearms Fund.

2becoming law.".
