A BILL FOR AN ACT

 

 

relating to workers' compensation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 386, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"Part    .  FILLING OF TEMPORARY VACANCIES

     §386-A  Definitions.  As used in this part, unless the context otherwise requires:

     "State employee" means a person employed by the State of Hawaii who is unable to work because of an injury suffered during the person's employment and who is receiving workers' compensation benefits because of the injury.

     "Temporary employee" means a person who is filling a state employee's position pursuant to this part.

     §386-B  Filling of temporary vacancies.  (a)  If a state employee is unable to work for six months, the director shall make a determination whether the state employee will be able to return to work within one year.  The director may consult with a group of health group providers in making this determination.  If the director determines that the state employee is unable to return to work within one year, the director shall coordinate with the hiring authority of the state employee to temporarily fill the state employee's position while the state employee is incapacitated. 

     (b)  The director shall ensure that each state position that remains vacant for a period of one year or longer because of a state employee's incapacity shall be filled by a temporary employee for the remainder of the period for which the state employee continues to receive workers' compensation benefits. 

     (c)  If the director determines that a state employee is unable to return to work within one year, the director shall work with the state employee's hiring authority to ensure that the wages of the position that is temporarily vacated by the state employee is deposited into the workers' compensation temporary vacancy special fund and that those wages are paid to the temporary employee filling the state employee's position.

     §386-C  Workers' compensation temporary vacancy special fund.  (a)  There is established the workers' compensation temporary vacancy special fund within the department into which shall be deposited the following moneys:

     (1)  State employee wages; and

     (2)  Appropriations by the legislature.

     (b)  The fund shall be used to pay the wages of temporary employees pursuant to section 386-B."

     SECTION 2.  In codifying the new sections added by section 1 of this Act, the revisor of statutes shall substitute appropriate section numbers for the letters used in designating the new sections in this Act.

     SECTION 3.  This Act shall take effect on July 1, 2015.
