       Senator Jones moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 558 - 565
    4  and insert:
    5         (1)(a)Except as provided in subsections (3), (4), and (5),
    6  a person who knowingly and willfully transports into this state
    7  an individual whom who the person knows, or reasonably should
    8  know, has entered is illegally entering the United States in
    9  violation of law and has not been inspected by the Federal
   10  Government since his or her unlawful entry from another country
   11  commits a felony of the third degree, punishable as provided in
   12  s. 775.082, s. 775.083, or s. 775.084.
   13         (b)This subsection does not apply to any of the following
   14  individuals under the Immigration and Nationality Act:
   15         1.A naturalized United States citizen;
   16         2.An individual with lawful permanent resident status or
   17  with a pending application for permanent residency, including
   18  under the Cuban Adjustment Act;
   19         3.A recipient of Temporary Protected Status or an
   20  individual with a pending application for Temporary Protected
   21  Status;
   22         4.An individual on parole with a valid parole document
   23  issued by the United States Citizenship and Immigration
   24  Services;
   25         5.An individual who is in possession of a T Nonimmigrant
   26  Visa (T Visa) or a U Nonimmigrant Visa (U Visa) or who is
   27  protected under the immigration provisions of the Violence
   28  Against Women Act (VAWA);
   29         6.An individual who has a pending petition for a T Visa or
   30  a U Visa, or under VAWA;
   31         7.A recipient of or an individual with a pending
   32  application for Deferred Action for Childhood Arrivals (DACA);
   33  or
   34         8.An unaccompanied alien child as defined in 6 U.S.C. s.
   35  279(g)(2).
