The Committee on Rules (Ingoglia) recommended the following:
1 Senate Amendment (with title amendment)

3 Delete lines 361 - 383
4 and insert:
5 following persons or entities may request, and a public or
6 private employer must provide, copies of any documentation
7 relied upon by the private employer for the verification of a
8 person’s employment eligibility, including, but not limited to,
9 any documentation required under paragraph (b) or paragraph (c):
10 a.1. The Department of Law Enforcement.
11 b.2. The Attorney General.
12 c.3. The state attorney.
13 d.4. The statewide prosecutor.
14 e. The Department of Economic Opportunity.
15 2. A person or entity that makes a request under this
16 paragraph must rely upon the Federal Government to verify a
17 person’s employment eligibility and may not independently make a
18 final determination as to whether a person is an unauthorized
19 alien. If the person or entity determines or finds that a public
20 or private employer has violated this section, the person or
21 entity must notify the Department of Economic Opportunity.
22 (f) If a public or private employer does not comply with
23 paragraph (b) or paragraph (c), the Department of Economic
24 Opportunity must: shall
25 1. Require the public or private employer to provide an
26 affidavit to the department stating that the public or private
27 employer will comply with paragraphs paragraph (b) and (c), the

32 Delete lines 61 - 68
33 and insert:
34 unauthorized alien; authorizing specified entities and
35 the Department of Economic Opportunity to request, and
36 requiring a public or private employer to provide,
37 copies of specified documentation; requiring a person
38 or an entity that determines or finds that a public or
39 private employer has violated certain provisions to
40 notify the department; revising the required actions
41 that the department must take if a public or private
42 employer does not comply with
