Section 784.031, Florida Statutes, is created to 13 read: 14 784.031 Battery by strangulation.— 15 (1) A person commits battery by strangulation if he or she 16 knowingly and intentionally, against the will of another person, 17 impedes the normal breathing or circulation of the blood of that 18 person, so as to create a risk of, or cause, great bodily harm 19 by applying pressure on the throat or neck of the other person 20 or by blocking the nose or mouth of the other person. This 21 subsection does not apply to any act of medical diagnosis, 22 treatment, or prescription which is authorized under the laws of 23 this state. 24 (2) A person who violates subsection (1) commits a felony 25 of the third degree, punishable as provided in s. 775.082, s. 26 775.083, or s. 775.084. 27 Section 2.
