       Senator Brandes moved the following:
       
    1         Senate Amendment to Amendment (462662)

    3         Delete lines 7150 - 7206
    4  and insert:
    5         Section 152. Criminal Punishment Code Task Force.—
    6         (1) The Task Force on the Criminal Punishment Code, a task
    7  force as defined in s. 20.03(8), Florida Statutes, is created
    8  adjunct to the Department of Legal Affairs for the purpose of
    9  reviewing, evaluating, and making recommendations regarding
   10  sentencing for and ranking of noncapital felony offenses under
   11  the Criminal Punishment Code. The task force shall include an
   12  analysis of best practices in its review.
   13         (2) The task force is composed of the following members:
   14         (a) The Attorney General, or a designee of the Attorney
   15  General, who shall serve as chair of the task force.
   16         (b) The Secretary of Corrections, or a designee of the
   17  secretary.
   18         (c) Two members appointed by the President of the Senate,
   19  one of whom must be a public defender.
   20         (d) Two members appointed by the Speaker of the House of
   21  Representatives, one of whom must be a state attorney.
   22         (e) Two members appointed by the Chief Justice of the
   23  Supreme Court, one of whom must be a circuit judge currently
   24  assigned to a felony division.

   26  Any vacancies on the task force shall be filled in the same
   27  manner as the original appointments. Appointments to the task
   28  force shall be made no later than July 15, 2019.
   29         (3)The task force shall meet throughout its duration and
   30  is encouraged to take input from all stakeholders involved in
   31  the criminal justice system. The first meeting of the task force
   32  shall occur no later than August 15, 2019. The Attorney General
   33  shall designate staff of the Department of Legal Affairs to
   34  provide support to the task force.
   35         (4) Upon the Attorney General’s request, the Department of
   36  Corrections and the Office of the State Courts Administrator
   37  shall provide necessary data collection and analysis, research,
   38  and support services to the task force.
   39         (5)Members of the task force may not receive compensation
   40  other than their usual salaries received from their employers,
   41  but are entitled to reimbursement for per diem and travel
   42  expenses from their employers in accordance with s. 112.061,
   43  Florida Statutes.
   44         (6)The task force shall submit a report to the Governor,
   45  the President of the Senate, the Speaker of the House of
   46  Representatives, and the Chief Justice of the Supreme Court no
   47  later than June 30, 2020, which must include, at a minimum, the
   48  issues considered by the task force, any recommendations for
   49  legislative changes, and an analysis of the expected impact of
   50  such recommendations if enacted by the Legislature. The task
   51  force is dissolved upon submission of the report.
   52         (7) This section expires July 1, 2020.
