       Senator Stewart moved the following:
       
    1         Senate Amendment to Amendment (234288) (with title
    2  amendment)
    3  
    4         Between lines 1298 and 1299
    5  insert:
    6         (9)Until such time as the Legislature has the opportunity
    7  to review and adopt the recommendations from the commission, an
    8  assault weapon or a large-capacity magazine, as defined in s.
    9  790.30, may not be sold, distributed, transferred or conveyed,
   10  kept for sale, or offered or exposed for sale.
   11         Section 20. Section 790.30, Florida Statutes, is created to
   12  read:
   13         (1)DEFINITIONS.—As used in this act, the term:
   14         (a)“Assault weapon” means:
   15         1. A selective-fire firearm capable of fully automatic or
   16  burst fire at the option of the user.
   17         2. A part or combination of parts that convert a firearm
   18  into an assault weapon, or any combination of parts from which
   19  an assault weapon may be assembled if those parts are in the
   20  possession or under the control of the same person.
   21         3.A firearm not listed in this paragraph which meets the
   22  criteria of one of the following sub-subparagraphs:
   23         a.A semiautomatic rifle that has an ability to accept a
   24  detachable magazine and that has one or more of the following:
   25         (I)A pistol grip that protrudes conspicuously beneath the
   26  action of the weapon or any feature functioning as a protruding
   27  grip that can be held by the nontrigger hand or a thumbhole
   28  stock.
   29         (II)A bayonet mount.
   30         (III)A flash suppressor or threaded barrel designed to
   31  accommodate a flash suppressor.
   32         (IV)A grenade launcher.
   33         (V)A shroud that is attached to the barrel, or that
   34  partially or completely encircles the barrel and allows the
   35  bearer to hold the firearm with the nontrigger hand without
   36  being burned, but excluding a slide that encloses the barrel.
   37         b.A semiautomatic pistol that has an ability to accept a
   38  detachable magazine and that has one or more of the following:
   39         (I)The capacity to accept an ammunition magazine that
   40  attaches to the pistol at any location outside the pistol grip.
   41         (II)A threaded barrel capable of accepting a barrel
   42  extender, flash suppressor, forward handgrip, or silencer.
   43         (III)A slide that encloses the barrel and that allows the
   44  shooter to hold the firearm with the nontrigger hand without
   45  being burned.
   46         (IV)A semiautomatic version of an automatic firearm.
   47         (V)Any feature capable of functioning as a protruding grip
   48  that can be held by the nontrigger hand.
   49         (VI)A folding, telescoping, or thumbhole stock.
   50         c.A semiautomatic shotgun that has one or more of the
   51  following:
   52         (I)A pistol grip that protrudes conspicuously beneath the
   53  action of the weapon.
   54         (II)A thumbhole stock.
   55         (III)A fixed-magazine capacity in excess of 5 rounds.
   56         (IV)An ability to accept a detachable magazine.
   57         d.A semiautomatic pistol or a semiautomatic, centerfire,
   58  or rimfire rifle with a fixed magazine that has the capacity to
   59  accept more than 10 rounds of ammunition.
   60         e.A part or combination of parts designed or intended to
   61  convert a firearm into an assault weapon, or any combination of
   62  parts from which an assault weapon may be assembled if those
   63  parts are in the possession or under the control of the same
   64  person.
   65         (b)“Large-capacity magazine” means any ammunition feeding
   66  device with the capacity to accept more than 15 rounds, or any
   67  conversion kit, part, or combination of parts from which such a
   68  device can be assembled if those parts are in the possession or
   69  under the control of the same person, but does not include any
   70  of the following:
   71         1.A feeding device that has been permanently altered so
   72  that it cannot accommodate more than 7 rounds;
   73         2.A .22 caliber tube ammunition feeding device; or
   74         3.A tubular magazine that is contained in a lever-action
   75  firearm.

   77  And the title is amended as follows:
   78         Delete line 2541
   79  and insert:
   80         expiration of the commission; prohibiting an assault
   81         weapon or a large-capacity magazine from being sold,
   82         distributed, transferred or conveyed, kept for sale,
   83         or offered or exposed for sale until such time as the
   84         Legislature has the opportunity to review and adopt
   85         the commission’s recommendations; creating s. 790.30,
   86         F.S.; defining the terms “assault weapon” and “large
   87         capacity magazine”; creating s. 1001.212,
