House Comm: UNFAV . 02/26/2018 . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— The Committee on Rules (Rodriguez) recommended the following: 1 Senate Amendment to Amendment (345360) (with title 2 amendment) 3 4 Between lines 225 and 226 5 insert: 6 (3) POSSESSION.—A person may not, within this state, 7 possess a bump-fire stock. A person who violates this subsection 8 commits a felony of the third degree, punishable as provided in 9 s. 775.082, s. 775.083, or s. 775.084. 10 (4) RELINQUISHMENT AND DESTRUCTION.—A person who owns or is 11 in possession of a bump-fire stock may arrange in advance to 12 relinquish the device to a law enforcement agency, as defined in 13 s. 934.02, or the Department of Law Enforcement or, if the bump 14 fire stock is not relinquished, the person must destroy the 15 device. The law enforcement agency or the department must 16 destroy any relinquished or acquired bump-fire stock within a 17 reasonable time. 18 (5) APPLICABILITY.—This section does not apply to a law 19 enforcement agency or the Department of Law Enforcement after 20 taking possession of a bump-fire stock through relinquishment or 21 other lawful means or while preparing to destroy the device. 22 23 ================= T I T L E A M E N D M E N T ================ 24 And the title is amended as follows: 25 Delete lines 1764 - 1766 26 and insert: 27 distribution, transport, sale, giving, or possession 28 of a bump-fire stock in this state; providing criminal 29 penalties; authorizing a person to relinquish a bump 30 fire stock to a law enforcement agency or the 31 Department of Law Enforcement; requiring a person who 32 does not relinquish a bump-fire stock to destroy the 33 device; requiring the law enforcement agency or the 34 department to destroy relinquished or acquired bump 35 fire stocks; providing applicability; providing 36 legislative intent; providing a
