House . . . . . ————————————————————————————————————————————————————————————————— ————————————————————————————————————————————————————————————————— Senator Rodriguez moved the following: 1 Senate Amendment (with title amendment) 2 3 Between lines 425 and 426 4 insert: 5 (3) POSSESSION.—A person may not, within this state, 6 possess a bump-fire stock. A person who violates this subsection 7 commits a felony of the third degree, punishable as provided in 8 s. 775.082, s. 775.083, or s. 775.084. 9 (4) RELINQUISHMENT AND DESTRUCTION.—A person who owns or is 10 in possession of a bump-fire stock may arrange in advance to 11 relinquish the device to a law enforcement agency, as defined in 12 s. 934.02, or the Department of Law Enforcement or, if the bump 13 fire stock is not relinquished, the person must destroy the 14 device. The law enforcement agency or the department must 15 destroy any relinquished or acquired bump-fire stock within a 16 reasonable time. 17 (5) APPLICABILITY.—This section does not apply to a law 18 enforcement agency or the Department of Law Enforcement after 19 taking possession of a bump-fire stock through relinquishment or 20 other lawful means or while preparing to destroy the device. 21 22 ================= T I T L E A M E N D M E N T ================ 23 And the title is amended as follows: 24 Delete lines 61 - 63 25 and insert: 26 distribution, transport, sale, giving, or possession 27 of a bump-fire stock in this state; providing criminal 28 penalties; authorizing a person to relinquish a bump 29 fire stock to a law enforcement agency or the 30 Department of Law Enforcement; requiring a person who 31 does not relinquish a bump-fire stock to destroy the 32 device; requiring the law enforcement agency or the 33 department to destroy relinquished or acquired bump 34 fire stocks; providing applicability; providing 35 legislative intent; providing a
