    An act relating to health care service plans. 
 An act to add Section 129853 to the Health and Safety Code,
relating to health facilities, and making an appropriation therefor.

   AB 1335, as amended,  Gomez   Maienschein
 .  Health care service plans.  Office of
Statewide Health Planning and Development: construction of health
facilities.  
   Existing law requires the Office of Statewide Health Planning and
Development to pass upon and approve or reject all plans for the
construction or the alteration of any hospital building, as
specified. Existing law requires the office to determine and
establish an application filing fee that will cover the costs of
administering these requirements, and requires the deposit of these
fees into the Hospital Building Fund, which is continuously
appropriated for the use of the office in carrying out these
provisions.  
   This bill would require a person or entity requesting a copy of a
plan maintained by the office to bear the cost of producing the copy
of that plan. To the extent that this requirement would increase the
costs of administering the above-described requirements and amounts
of moneys from fees deposited into the Hospital Building Fund, this
bill would make an appropriation.  
   Existing law, the Knox-Keene Health Care Service Plan Act of 1975
(Knox-Keene Act), provides for the licensure and regulation of health
care service plans by the Department of Managed Health Care and
makes a willful violation of the act a crime. Existing law provides
that health care service plans shall not be deemed to be engaged in
the practice of a profession, and may employ, or contract with, any
licensed health care professional to deliver professional services,
and may directly own, and may directly operate through its
professional employees or contracted licensed professionals, offices
and subsidiary corporations.  
   This bill would declare the intent of the Legislature to enact
legislation to clarify the law with regard to health care service
plans and the entities with which a health care service plan may
transact business.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 129853 is added to the 
 Health and Safety Code   , to read:  
   129853.  The person or entity requesting a copy of a plan
maintained by the office shall bear the cost of producing the copy of
that plan.  
  SECTION 1.    It is the intent of the Legislature
to enact legislation to clarify the law with regard to health care
service plans that are regulated under the Knox-Keene Health Care
Service Plan Act of 1975 (Chapter 2.2 (commencing with Section 1340)
of Division 2 of the Health and Safety Code) and the entities with
which a health care service plan may transact business.
