SB 680, as amended, Skinner. Consumer Legal Remedies Act. Battery-powered motor vehicle price: consumer notice.

Existing law, the Consumer Legal Remedies Act, provides that specified unfair methods of competition and unfair or deceptive acts or practices undertaken by any person in a transaction intended to result or that results in the sale or lease of goods or services to any consumer are unlawful.

Existing law imposes specified requirements on dealers of motor vehicles sold or leased in this state, including prohibiting a dealer from advertising the total price of a vehicle without including all costs to the purchaser at the time of sale, except as specified.
This bill would make those provisions applicable to selling any require a dealer that sells or leases a vehicle propelled by a battery-powered motor at a price greater than to provide notice to a consumer if the price exceeds the manufacturer’s suggested retail price. price, as specified.

The people of the State of California do enact as follows:


SECTION 1.

 Title 1.5B (commencing with Section 1784.2) is added to Part 4 of Division 3 of the Civil Code, to read:

TITLE 1.5B. Battery-powered Motor Vehicle Advertising

1784.2.
 (a) For purposes of this section, the following definitions apply:
(1) “Dealer” has the same meaning as in Section 285 of the Vehicle Code.
(2) “Vehicle” has the same meaning as in Section 670 of the Vehicle Code.
(b) If a dealer sells or leases a vehicle that is partially or exclusively propelled by a battery-powered motor at a price that exceeds the manufacturer’s suggested retail price, the dealer shall provide clear and conspicuous notice to a consumer that the price exceeds the manufacturer’s suggested retail price.
