An act to amend Section 34000 of the Penal Code, relating to firearms. An act to amend Section 88651 of the Education Code, relating to economic development.

AB 3087, as amended, Mike Fong. Firearms: destruction. California Community Colleges Economic and Workforce Development Program.
Existing law establishes the California Community Colleges Economic and Workforce Development Program to, among other things, advance California’s economic growth and global competitiveness through education, training, and services that contribute to continuous workforce improvement. Existing law authorizes the Board of Governors of the California Community Colleges to award grants and project funds to community college districts for the program, as specified. Existing law requires the program to be implemented only during those fiscal years for which funds are appropriated for its purposes. Existing law repeals the program on January 1, 2025.
This bill would extend the operation of the California Community Colleges Economic and Workforce Development Program by 5 years to January 1, 2030.

Previous law authorized a law enforcement agency to dispose of seized, surrendered, abandoned, and unclaimed firearms by sale at a public auction or by destruction. Existing law requires these firearms to be disposed of by destruction.

This bill would make a conforming change and technical correction to this provision.

The people of the State of California do enact as follows:


SECTION 1.

 Section 88651 of the Education Code is amended to read:

88651.
 This part shall remain in effect only until January 1, 2025, 2030, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2025, 2030, deletes or extends that date.

SECTION 1.Section 34000 of the Penal Code is amended to read:
34000.

(a)Notwithstanding any provision of law or of any local ordinance to the contrary, when any firearm is in the possession of any officer of the state, or of a county, city, or city and county, or of any campus of the University of California or the California State University, and the firearm is an exhibit filed in any criminal action or proceeding which is no longer needed or is unclaimed or abandoned property, which has been in the possession of the officer for at least 180 days, the firearm shall be destroyed as provided for in Sections 18000 and 18005.

(b)This section does not apply to any firearm in the possession of the Department of Fish and Game, or which was used in the violation of any provision in the Fish and Game Code, or any regulation under that code.
