Title: Addressing Crime through Targeted Interventions and Violence Enforcement (“ACTIVE”) Amendment Act of 2023
Description: As introduced Bill 25-479 would require individuals on probation, supervised release, or parole following a conviction for a gun offense be required to submit to a search when they are in a public place. It would create a Prearrest Diversion Task Force charged with developing recommendations for increasing the use of prearrest diversion. It would increase the maximum penalty for individuals firing a large number of bullets at a time. It would require that sentences for possession of extremely dangerous weapons like machine guns be stacked on top of baseline penalties, not run concurrently, and create a new offense of unlawful discarding of firearms and ammunition. It would amend the definition of carjacking to include situations where the victim is not in or immediately next to their vehicle among other things.
